If the applicant has been deemed guilty of such a serious crime or the repetition of such a crime, the hiring or retention of such an applicant could result in a civil lawsuit for negligent hiring and retention. Should the applicant commit a similar crime against a fellow employee or other person while under the employment of the company, the employer may be held liable.
